01About this policy
This Privacy Policy explains how LUMOS ELD LLC (“Lumos ELD”, “we”, “us” or “our”) collects, uses, shares and protects personal information when you visit lumoseld.com, contact us, or use the Lumos ELD driver app, web portal and ELD devices (the “Services”).
Lumos ELD provides the Services to motor carriers. For records of duty status, vehicle and location data collected for a carrier’s fleet, we act on behalf of that carrier, which decides how its drivers’ data is used. Drivers with questions about their employer’s use of ELD data should contact their carrier first; we will help the carrier respond.
02Information we collect
Information you give us. Name, company, email address, phone number, fleet size and message when you request a demo or contact us; account details for carrier administrators and drivers, such as name, username, driver’s license number and issuing state, carrier name and USDOT number, home terminal and time zone; DVIR entries, notes, signatures and support requests.
ELD and hours-of-service records. Duty status changes, certifications, edits and annotations, log-in and log-out events, unidentified driving records, malfunction and data diagnostic events, and the other data elements an ELD must record under 49 CFR Part 395, Subpart B.
Vehicle data. Data read from the vehicle through the ELD device, such as engine hours, odometer, vehicle speed, engine power status, VIN, diagnostic trouble codes and fuel-related readings, plus device identifiers and firmware versions.
Location data. The ELD records vehicle location at each duty status change and at regular intervals while driving, as the ELD rule requires. Location in ELD records is reduced to approximately a 1-mile radius, or approximately a 10-mile radius during authorized personal conveyance. If your carrier uses GPS tracking features, location may be collected more often while the vehicle is in operation.
Device and usage data. Mobile device model, operating system, app version, IP address, crash logs and basic usage events, used to keep the Services working and secure.
Website data. Our website uses only cookies and local storage needed for it to function. We do not use advertising cookies. Web fonts are loaded from Google Fonts, which receives your IP address when the page loads.
03How we use information
- to provide, operate and support the Services, including hours-of-service calculations, alerts, DVIR, tracking and IFTA reports;
- to enable compliance with FMCSA rules, including displaying records and transferring ELD output files to FMCSA or authorized safety officials at the driver’s request;
- to respond to inquiries and demo requests and to provide customer support;
- to send service, security and account messages, and SMS messages where you have opted in;
- to monitor, troubleshoot and improve the Services, and to detect and prevent fraud, abuse and security incidents;
- to meet legal obligations, enforce our Terms and protect our rights and the rights of others.
We do not sell personal information, and we do not use ELD records for targeted advertising.
05SMS messages
If you check the SMS consent box on our website or opt in within the Services, we use your phone number to send text messages about your inquiry, account notifications and customer support. Message frequency varies; message and data rates may apply. Reply STOP to opt out at any time or HELP for help. Consent is not a condition of purchase. See the SMS messaging terms in our Terms of Service.
06How long we keep information
We keep ELD records and supporting data for as long as the carrier’s account is active and as needed to meet legal requirements — records of duty status and supporting documents must be kept for at least 6 months under 49 CFR 395.8(k). After an account ends, the carrier can export its data for 30 days; we then delete or de-identify it unless the law requires us to keep it. Website inquiries are kept for as long as needed to respond and follow up, and then deleted.
07How we protect information
We use administrative, technical and physical safeguards appropriate to the data, including encryption in transit, access controls based on roles, and logging of access to ELD records. ELD output files are transferred to FMCSA using the methods FMCSA specifies. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
08Your choices and rights
Depending on your state of residence, you may have the right to request access to, correction of, deletion of or a copy of your personal information, and to opt out of the sale of personal information or targeted advertising (we do neither). To make a request, email info@lumoseld.com. We will verify your request and respond as the law requires. If the request concerns ELD records we hold for a carrier, we will refer it to that carrier. Certain ELD records cannot be deleted before the retention period required by federal regulations ends. We will not discriminate against you for exercising your rights.
09Children’s privacy
The Services are intended for businesses and adults. We do not knowingly collect personal information from children under 16. If you believe a child has provided us information, contact us and we will delete it.
10Changes to this policy
We may update this Privacy Policy from time to time. We will post the updated version on this page with a new effective date and, for material changes, notify account administrators by email or in the Services.
